The obligation
Under the EU Omnibus / Price Indication Directive, Article 6a, any reduction you announce must state the lowest price in the 30 days before a reduction as the prior price — not the price you happened to charge the day before. The rule has been in force since 28 May 2022, and the Court of Justice (case C-330/23, 26 September 2024) confirmed the reduction must be calculated against that 30-day-lowest figure.
The enforcement risk
This is no longer theoretical. In January 2026 Poland's competition authority, UOKiK, published fines for Omnibus breaches:
- Zalando — approximately 30,945,000 PLN
- Temu — approximately 5,910,900 PLN
Small Wix Stores merchants face the same rule, and most meet it manually or not at all.
